MagicDish AI — Terms of Service and Privacy Policy

Acceptance of Terms of Service

These Terms of Service form a legally binding agreement between you and MagicDish AI for the use of our website, applications and any related services; by accessing or using the service in any manner you confirm that you have read, understood and agreed to be bound by these Terms and any additional policies we post from time to time, and continued use of the service after changes are posted constitutes acceptance of the revised Terms.

Rules and Conduct

MagicDish AI enables users to upload their own food photographs and produce professionally enhanced images, and you agree to use the service only for lawful purposes, to obtain any permissions necessary for the photos you upload, to refrain from infringing the rights of others, to avoid content that is unlawful, harmful, defamatory, exploitative, misleading or otherwise prohibited, and to accept that we may monitor, remove or block content or accounts that violate these rules at our sole discretion.

Prohibited Uses

You must not use the service in any way that violates applicable laws, attempts to reverse-engineer or interfere with the platform, imposes an unreasonable load on our infrastructure, misrepresents the origin of images, exploits or depicts minors, promotes violence or hateful conduct, generates deepfakes intended to deceive, or otherwise breaches these Terms, and we reserve the right to restrict or terminate access for any such misuse.

DMCA and Takedowns Policy

Because AI processing can inadvertently resemble protected works, we respect intellectual-property owners and will respond to properly formatted notices of alleged infringement; if you believe material hosted on MagicDish AI violates your copyright or trademark rights you must send a detailed DMCA notice to our legal email, after which we will promptly disable or remove the material and may terminate repeat infringers.

Modification of Terms of Service

We may amend these Terms, change features or discontinue parts of the service at any time by posting an updated version or otherwise notifying you, and it is your responsibility to review the Terms periodically because continued use after changes take effect constitutes acceptance of the amended Terms.

Trademarks and Patents

"MagicDish AI," our logos and related marks are our proprietary trademarks, all other trademarks referenced on the service belong to their respective owners, and certain features may be protected by patent applications or patents; nothing in these Terms grants you any license to use our marks without prior written permission.

Licensing Terms

Subject to your compliance with these Terms we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service, you retain ownership of all AI-enhanced images you create, and you grant us a worldwide, royalty-free license to host, process and display your uploads and AI-enhanced images solely to operate, improve and promote the service, while you may make your own images public for others to view if you choose.

Fees and Payments

MagicDish AI is a paid digital service that begins processing immediately upon purchase, you therefore waive any statutory withdrawal period, subscription plans renew automatically unless cancelled before the next billing cycle, fees are non-refundable once generation has begun, and we may modify pricing or plan features with changes applying on your next renewal.

Termination

We may terminate or suspend your access to the service at any time for violation of these Terms, non-payment or other reasons we deem appropriate; upon termination all licenses granted to you cease, but sections relating to ownership, disclaimers, limitations of liability and indemnification will survive.

Indemnification

You agree to defend, indemnify and hold harmless MagicDish AI and its affiliates, officers, employees and agents from any claims, damages or expenses arising out of your use or misuse of the service, your violation of these Terms, or your infringement of any third-party rights.

Limitation of Liability

To the maximum extent permitted by law, MagicDish AI shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, whether arising in contract, tort or otherwise, and our aggregate liability will not exceed the amount you paid for the service in the three months preceding a claim or one hundred US dollars, whichever is greater.

Disclaimer

The service and all outputs are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement or uninterrupted availability, and you are solely responsible for ensuring that your use of the AI-enhanced images complies with all applicable laws and regulations.

Age Requirements

By accessing the service you affirm that you are at least eighteen years old or the age of majority in your jurisdiction, and if you are under the required age a parent or legal guardian must agree to these Terms on your behalf and will be responsible for your activity on the service.

Links to and From Other Websites

The service may contain links to third-party websites that are not controlled by MagicDish AI, and we are not responsible for the content or terms of those sites; linking to our site is permitted provided it does not imply endorsement, while framing, scraping or reproducing our content without permission is prohibited.

Dispute Resolution and Governing Law

Any dispute arising out of or relating to these Terms or the service that cannot be resolved informally will be submitted to binding arbitration under consumer arbitration rules in a mutually agreed venue, with each party waiving the right to a jury trial and class action, and the governing law will be determined by the jurisdiction in which MagicDish AI is incorporated, without regard to conflict-of-law principles.

Miscellaneous

These Terms constitute the entire agreement between you and MagicDish AI regarding the service and supersede all prior communications; if any provision is found unenforceable the remaining terms remain in effect, our failure to enforce any right is not a waiver, and we may assign our rights or obligations under these Terms without restriction while you may do so only with our written consent.

Refund & Dispute Policy

Because MagicDish AI delivers a digital service that starts processing immediately after purchase, all sales are generally final and non-refundable. We will, however, replace credits or issue a full refund only when an enhanced image is demonstrably unusable under the criteria below.

What counts as an "unusable" image

An image qualifies as unusable if, and only if, it meets one or more of these objectively verifiable conditions (which we confirm via server logs or the file you provide):

1. File-delivery failure: the download link we issued returns a 404 error or a zero-byte file.
2. Complete corruption: the image will not open in any standard viewer because the file header is damaged.
3. Blank or single-color output: the rendered file is entirely black, white or a solid color (excluding any transparent areas you requested).
4. Extreme artifacting: more than 25% of the pixels contain compression blocks, noise or other artifacts clearly caused by model failure rather than artistic style.
5. Missing subject: the primary subject you uploaded (e.g., your dish) is entirely absent from the enhanced result.
6. Incorrect resolution: the delivered file’s pixel dimensions differ by more than 20% from the resolution you selected at checkout.

Matters of personal taste, such as lighting, angle, color palette or artistic style, do not render an image unusable, nor do minor artifacts that do not materially affect commercial use.

How to request a credit or refund

Email support@magicdish.ai within fourteen (14) calendar days of purchase with your order ID, the defective file(s) attached and a brief note indicating which condition above applies. We typically resolve valid requests within five business days. If we cannot reproduce or reasonably verify the problem, we may ask for additional information before issuing a credit or refund.

Nothing in this policy limits any statutory rights you may have under applicable consumer-protection laws or your ability to dispute a charge directly with your payment provider.
